Conditions imposed at the hearing were as follows;

1. No use of alcohol and/or non-prescribed illegal drugs 2. random UA's 3.
Upon any positive UA, obtain a Rule 25 chemical assessment 4. Enter into and
successfully complete any programming recommended by a Rule 25.
5. Defendant is geographically restricted within a 6 block radius of 27th
and Colfax; must contact P.O. for permission to be in that area.
6. Maintain employment and or schooling; provide verification to probation
7. No association with known gang members; contact P.O if in doubt.
8. Enter into and successfully complete either RISE or African American
Men's Project

Delaney Burks was arrested at 2707 Colfax on July 14, 2008 at about 11pm for what appeared 
to be drug dealing. According to a witness Mr. Burks and three other individuals were in a parked 
car for about an hour engaging in what appeared to be drug dealing when another car pulled up 
behind and a fight ensued. A total of eight individuals were arrested, two cars were towed, and 
Burks was held on PC Narcotics but released without charges. It may take a very long time for 
charges to be brought in this case, if at all. 
 
Mr. Burks is no stranger to the Court or to the community. Since 2006, Mr. Burks has been 
arrested for incidents of domestic abuse, on weapons charges, for fleeing and for narcotics. The 
fact that he was released without conditions and supervision amounts to permission for future 
offense.  
 
Each time someone with Mr. Burks&#8217; history walks away from the Court and back into the 
community without oversight it is an invitation for further offense. Conditions of release and 
supervision are some of the backstops of community safety. 
 
Perhaps Mr. Burks and the Court do not realize that the community is watching. We declare that 
we are tired of the repeat offenders. In the 4th Precinct confidence in the police response 
remains intact, but many lose confidence when they hear charges are dropped or someone with 
a high CAPERS score returns quickly to the streets.  It&#8217;s with this in mind that we reach out to 
the Court and ask consideration of this impact statement. 
 
The 4th Precinct CARE Task Force is organizing to bring systems and coordination to crime 
fighting. The result has been an increasingly strategic police response.  Prosecution, use of 
geographic trespassing, and camera evidence have all helped.   
 
The City, with many partners, is leading the effort to revitalize the Northside.  We are 
particularly hampered in our efforts to reduce crime due to the revolving door effect which we 
see with chronic offenders.  We want to stop this revolving door starting with Mr. Burks and we 
ask that you consider the need for conditions and supervision while he is free in our 
neighborhoods. </description>
